The Recycled-Content "Algorithm" Has Arrived: How the EU Battery Regulation Turned Percentages into a Ledger

In one line: for two years the debate was about headline percentages — cobalt 16%, lithium 6%. On 12 August 2026 the European Commission published the draft delegated regulation that turns those targets into an auditable method: plant-level mass balance, quantity reconciliation and rolling averages, with accounting periods capped at 12 months and credits that cannot be carried over or transferred between plants. Adoption is planned for Q3 2026. The real compliance cost is not the percentages — it is the supply-chain documentation burden: from 2028 you must be able to evidence where every gram of recycled material came from.


1. The targets always existed. The method did not.

Article 8 of Regulation (EU) 2023/1542 already set recycled-content minima and their dates, but set no methodology for calculating, tracing or verifying them.

Three pieces filled that gap in 2026:

Public feedback ran to 9 September 2026; the WTO comment deadline is 13 October 2026; adoption is planned for October 2026, entering into force on the 20th day after publication in the Official Journal.


2. Who and what is in scope

The "per model × per year × per plant" rule is the most under-estimated part. The same battery produced at two plants must be calculated separately; different models from one plant must also be separate. The data granularity is not one group-level spreadsheet — it is a set of independent ledgers.


3. Why "plant-level mass balance" won

The JRC study first ruled out three alternatives:

What survived is plant-level mass balance, supported by quantity reconciliation and credit allocation:

  • Within an accounting period, reconcile recycled material inputs against outputs
  • Allocate recycled content proportionally across all outputs produced in that period
  • Qualifying contractual arrangements may allow direct allocation to specified output materials
  • Credits cannot be carried over to the next accounting period, nor transferred between plants or companies
  • Data must be retained for at least 10 years

In one sentence: the method does not rely on physical testing of the finished product. It relies on full-chain documentation and reconciliation. What it tests is not laboratory capability — it is contract terms and data pipelines.


4. A temporary factor reserved for EU recycling

The draft introduces a temporary incentive: until 31 December 2036, lithium, nickel and cobalt obtained from recycling carried out entirely within a Member State (from waste-battery treatment through material recovery) may be multiplied by a 1.3 correction factor when calculating recycled content.

Three limits apply simultaneously:

  1. Used once only — applied at the first step immediately following the recycling step in the value chain
  2. The result must not exceed 100%
  3. Does not apply to lead

Characterise it precisely: this is a supply-resilience incentive, not an exclusion of non-EU recycled material — non-EU recycled content still counts, it simply does not receive the factor.

The Battery Passport and recycled content are separate obligations that draw on the same data. The draft explicitly recommends designing the data foundation together with the passport rather than building two systems.


6. China's approach, side by side

On the same "battery recycling" question, the two sides enter from different angles:

A factual scale reference: in 2025 China's comprehensive utilisation of retired traction batteries exceeded 400,000 tonnes, up 32.9% year on year.

⚠️ The two sets of indicators are not directly comparable. The EU measures how much recycled material is inside a battery placed on the EU market; China reports domestic recycling and utilisation volumes. One is a product-content measure, the other a throughput measure. They are placed side by side to show institutional position, not to rank anything.


7. Boundaries and definitions

  1. The draft is not yet law. Published 2026-08-12, feedback closed 2026-09-09, adoption planned for Q3 2026 — it was still in the legislative process when this was written. Any data system designed against the draft should leave room for the final text to differ.
  2. The 1.3 factor and the WTO comment deadline are taken from published texts and notification information. The author did not read the draft delegated act in full (5-page act plus 15 annex pages); confidence B.
  3. "Planned for October 2026" is a planned date in the notification — not an accomplished fact.
  4. No commercial data vendors are used; WTO notifications, European Commission and JRC outputs are all official publications.
